Introduction and Effectiveness of the General Conditions

These general conditions of sale govern the purchase of Products and services made at a distance and made available through the internet network by the Websitewww.miamo.com (hereinafter, the "Website") in compliance with the current Italian legislation, including Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the "Consumer Code"), where applicable, and in compliance with national and international legislation regarding e-commerce.

The seller of the products and owner of the website is Medspa S.r.l., represented by its legal representative, with registered office in Milan, at Corso Sempione, No. 17 (hereinafter "Seller").

The user accessing the Website to make purchases (hereinafter "Customer") is required to carefully read this document made available on the Website and accepted during the account registration process.

Selecting and Ordering Products

The characteristics and price of the various Products for sale on the Website (hereinafter "Product" or "Products") are listed on the page corresponding to each Product.

To purchase Products at retail, the Customer must complete and submit the electronic order form, following the instructions provided on the Website.

By adding the Product to the cart, shipping details and any billing information (if the purchase is to be made with own VAT number, an electronic certified email address or alternatively the SDI code must be provided) must be entered, then the desired payment method must be selected, and the order confirmed.

By submitting the order through the Website, which constitutes a contractual proposal, the Customer acknowledges and declares to have read all the information provided to them during the purchasing process and to fully accept this document and the Privacy Policy.

The contract concluded between Medspa S.r.l. and the Customer must be considered concluded upon acceptance of the order by the Seller.

This acceptance is communicated to the Customer through an order confirmation email, containing the order number, shipping and billing details, the list of ordered Products with their essential characteristics and the total price, including any delivery charges.

Upon receiving the confirmation email, the Customer may modify the order until the update message sent is displayed in their Customer area.

After this update, no further changes will be accepted, and if the Customer is identified as a consumer, they must exercise their right of withdrawal, as provided by current regulations.

After receiving the order and verifying the correctness and completeness of the data, Medspa S.r.l. will proceed with processing the order.

In case one or more Products are not available, the customer service will promptly notify the Customer through the contact channels provided by the Customer during registration.

Within 72 hours of the communication of the unavailable Product, the Customer may choose to wait for the Product to become available, according to the timing indicated by the Seller, or cancel the order.

In case of order cancellation regarding unavailable Products, the amounts already paid by the Customer will be refunded within 72 hours, using the payment method chosen at the time of purchase.

Order cancellation will result in invoicing only for the processed Products.

 

Product Information

Information and characteristics regarding each individual Product are available on the respective page on the Website.

The visual representation of the Products, if available, is purely illustrative.

Any changes to the Product's packaging will not alter its quality and characteristics, as detailed in the respective product description.

 

Coupon Codes / Discount Vouchers / Promotions - Gifts

Medspa S.r.l. may include discount coupons inside packages, send them via email or through partner websites, which can be used until the expiration date indicated on the coupon itself.

The discount coupon must be entered on the cart page in the Discount Code box.

Once the code is applied, the system will update the total order amount net of the coupon value.

The use of the coupon is subject to the following conditions:

  • Coupons cannot be combined with other commercial initiatives;
  • Coupons have a predefined value or may be in the form of a percentage discount;
  • they have an expiration date indicated on the coupon itself;
  • the coupon does not entitle to change, will not be refunded, in whole or in part, and must be used before the expiration date. The coupon cannot be resold;
  • for fixed amount coupon codes, if the nominal value indicated is not sufficient to cover the order amount, the buyer may complete the order by paying the difference.

 

Prices and Shipping

Product prices are expressed in Euros and indicated on the relevant page.

Before proceeding with the purchase, the cart section shows the total cost of the goods and the shipping fee.

The Products sold are not subject to any import tax or customs duty if the Product is sold and delivered in Italy or within the European Union.

In the case of deliveries to countries outside the European Union, Products may be subject to import taxes and/or customs duties.

It is not possible to predict in any way whether and which costs would be incurred for customs clearance.

For more information, customers can contact the customs office of their country.

In any case, any costs related to import taxes and/or customs duties will be borne by the Customer.

 

Payment Methods and Invoicing

Payment Methods

The Customer may pay for the price of the Products and related shipping and delivery charges by credit card, debit card, online payment system (PayPal, Scalapay), bank transfer in advance, or cash on delivery:

 

Credit Card / Debit Card

Payment for Products purchased on the Website can be made by credit/debit card directly through the Website.

Medspa S.r.l. accepts credit/debit cards from the VISA, Mastercard, and Maestro circuits. Accepted credit/debit cards are indicated on the Website page. The total amount due from the Customer is charged at the time of order transmission.

To ensure the security of payments made on the Website and prevent fraud, Medspa S.r.l. reserves the right to request that the Customer, via email, send, in response to the received email, a copy of both sides of their identity card (valid).

The Customer is required to send the requested documents within the time specified in the email.

If Medspa S.r.l. does not receive these documents within the specified period indicated in the request email or receives expired or invalid documents, the contract will be deemed terminated by operation of law under and for the purposes of Article 1456 of the Italian Civil Code, and the order will consequently be canceled, without prejudice to Medspa S.r.l.'s right to compensation for any damages it may incur due to the Customer's non-compliant behavior.

The resolution of the contract, of which the Customer will be notified by email, will result in the cancellation of the order with the consequent refund of the total amount due, if paid, by crediting it back to the same payment method used.

In the event of payment by credit card, the Customer will be transferred to a secure site and the credit card data will be communicated directly to the financial institution, which manages the transaction remotely, without any third party having access to it in any way.

This data is transmitted in encrypted form, i.e., using the SSL (Secure Socket Layer) protocol.

 

Cash on Delivery (COD)

Cash on delivery is a payment method that allows the Customer to pay the full order amount directly to the courier upon delivery of the Products.

This method is subject to a surcharge, which will be communicated to the Customer at the time of order confirmation.

In the event of cash on delivery, payment is made exclusively in cash, and no other payment method will be accepted.

The courier only accepts exact amounts corresponding to the total of the order and any additional costs, if provided, and does not give change.

Medspa S.r.l. reserves the right to refuse payment by cash on delivery, at its sole discretion, without the Customer being entitled to claim compensation or indemnification for any reason.

In the event of refusal of payment by cash on delivery, the Customer will be notified by email, and the order will be canceled.

 

Bank Transfer

Payment by bank transfer must be made in favor of Medspa S.r.l. using the bank details indicated on the order confirmation email.

Payment must be made within 3 (three) working days from the order confirmation date.

If payment is not received within this period, the order will be automatically canceled, and the Products will be put back on sale.

Payment by bank transfer involves additional processing times compared to other payment methods, as the order is processed only after payment is credited to the Seller's account.

The time required for crediting may vary depending on the bank used and the payment date.

For faster order processing, the Customer is invited to send a copy of the bank transfer receipt to the Seller's email address info@miamo.com.

 

Payment via PayPal

To make payments via PayPal, the Customer must have a PayPal account and follow the instructions provided during the payment process.

After selecting the PayPal payment method, the Customer is directed to the PayPal login page to access their account and complete the payment.

The Customer's financial data will be managed directly by PayPal, which guarantees the confidentiality and security of the transaction.

In case of cancellation of the order and in all other cases of reimbursement, for any reason, the refund amount will be credited to the Customer's PayPal account.

 

Scalapay Payment

Scalapay is a payment method that allows the Customer to pay for the order in three interest-free installments.

This payment method is subject to acceptance by Scalapay, which may evaluate the Customer's creditworthiness before approving the transaction.

The Customer must select the Scalapay payment method during the checkout process and follow the instructions provided on the Website.

If the payment is approved by Scalapay, the order will be confirmed, and the Customer will receive an order confirmation email.

The first installment is debited at the time of purchase, while the second and third installments will be automatically charged to the Customer's payment method on the dates indicated in the payment schedule.

If Scalapay does not approve the transaction, the order will be canceled, and the Customer will be notified via email.

 

Order Processing and Delivery Times

Medspa S.r.l. undertakes to process orders within 1-2 working days from the date of receipt of payment.

Orders placed on weekends or public holidays will be processed on the first working day following the order confirmation date.

Once the order has been processed, the Products will be entrusted to the courier for shipment, and the Customer will receive a shipping confirmation email containing the tracking code to monitor the status of the shipment.

Delivery times may vary depending on the destination address and the chosen shipping method.

 

Right of Withdrawal

The Customer has the right to withdraw from the contract without specifying the reason within 14 days from the date of receipt of the Products.

The right of withdrawal must be exercised by sending a written communication to Medspa S.r.l., to the address indicated in the Contacts section of the Website, by email to info@miamo.com, or by registered letter with return receipt.

The communication must contain:

  • the express intention to withdraw from the contract;
  • the order number;
  • the Product(s) for which the right of withdrawal is exercised;
  • the Customer's details (name, surname, address);
  • the Customer's bank details to receive the refund (IBAN).

The Customer must return the Products to Medspa S.r.l., at their own expense, within 14 days from the date of communication of withdrawal.

The returned Products must be intact, unused, complete with all their parts and in their original packaging.

The right of withdrawal does not apply to:

  • Products made to measure or clearly personalized;
  • sealed Products that cannot be returned for hygienic reasons or related to health protection, once opened after delivery.

Upon receipt of the returned Products, Medspa S.r.l. will verify their integrity and conformity with the conditions indicated above.

If the verification is successful, Medspa S.r.l. will proceed with the refund of the amount paid by the Customer for the purchase of the returned Products.

The refund will be made using the same payment method used by the Customer for the initial transaction, unless otherwise agreed between the parties.

In any case, the Customer will not incur any costs as a consequence of the refund.

The refund may be suspended until receipt of the returned Products or until the Customer provides proof of shipment, whichever occurs first.

If the verification of the returned Products reveals any damage or non-compliance, Medspa S.r.l. reserves the right to withhold the refund, in whole or in part, to compensate for the damage suffered.

In this case, Medspa S.r.l. will notify the Customer by email and provide details of the refund, if applicable.

 

Warranty and Assistance

The Products purchased on the Website are covered by the legal guarantee of conformity provided for by Legislative Decree 206/2005 (Consumer Code) and subsequent amendments.

The warranty applies to Products with lack of conformity, provided that the Products have been used correctly, respecting their intended use and the instructions for use and maintenance provided by the manufacturer.

The legal guarantee of conformity is reserved for consumers.

For customers who are not consumers, the warranty is 12 months from the date of purchase.

The lack of conformity must be reported to Medspa S.r.l. within 2 months from the date of discovery.

In case of lack of conformity, the Customer has the right to request, at their choice and subject to the conditions provided for by law, the repair or replacement of the Product, or a price reduction or the termination of the contract.

 

Applicable Law and Jurisdiction

The sales contract between the Customer and Medspa S.r.l. is concluded in Italy and governed by Italian law.

For any dispute arising from the interpretation, execution, and termination of the contract, the competent court is the Court of Milan, without prejudice to the application of mandatory legal provisions protecting consumers.
